PRIVACY NOTICE issued by ARIZA DE MÉXICO, S.A. DE C.V. hereinafter "ARIZA"), with address at Boulevard Manuel Ávila Camacho number 685, 9th Floor, Industrial Alce Blanco, Municipality of Naucalpan de Juárez, State of Mexico, ZIP Code 53370; in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter FLPPD) and its Regulation (RFLPPD).

PERSONAL DATA WE COLLECT.

For the purposes mentioned later in this document, we need to obtain the following personal data that you provide directly through various means, in order to acquire a service offered by ARIZA. The data we obtain in each case may include, among others:

  • Occupation and, if applicable, employment or activity details.
  • Name or Business Name of your current and/or previous employer.
  • RFC (Tax ID).
  • Name of the Legal Representative.

  • Email.
  • Other contact details.

In case this information is not provided, we would not be able to keep our records updated, offer our services, or provide timely follow-up to the requested service, and remind you of timely maintenance services, insurance, warranties, campaigns, and everything related to your vehicle, as well as address complaints and suggestions.

PURPOSE OF PROCESSING THE PERSONAL DATA WE COLLECT.

  • Verify and confirm your identity.
  • Provide the services requested.
  • Provide maintenance services if contracted with ARIZA.
  • Address your requests, complaints, doubts, and/or comments related to our services.
  • Register and provide services related to ARIZA.
  • Identify you as a client of the services offered by ARIZA.
  • Contact you and offer our services and information from our business partners.
  • Evaluate the quality of the service we provide.
  • Maintain communication in general, as well as follow up on our commercial relationship.
  • In case of formalizing with you the acceptance of any service offered by ARIZA, your data will only be used to fulfill the obligations arising from that legal relationship.
  • Transfer within ARIZA or its subsidiaries to offer related products and services.
  • Transfer to third parties related to provide information, services, etc.
  • Conduct an analysis that allows us legal certainty about the viability and legal and correct forms in the execution of contracts, agreements, and other acts necessary for the due fulfillment of the obligations arising from the probable legal relationship.
  • Analyze whether you have the legal, economic, infrastructure, and personnel requirements necessary to fulfill your possible obligations in providing the services required by ARIZA.
  • In case of formalizing with you the acceptance of providing a service required by ARIZA, your data will be used to fulfill the obligations arising from that legal relationship and to comply with tax provisions in issuing tax receipts.
  • Prepare, plan, coordinate, supervise, and audit the work that involves the provision of services contracted with ARIZA.
  • Inform you about the changes that may become necessary over time.
  • Other purposes necessary for the provision of the services you require.

You or your company as a supplier must adhere to and ensure that your employees adhere to the rules established in this PRIVACY NOTICE, the FLPPD, and the RFLPPD, in the processing of data owned by ARIZA's clients and whose transfer to you or to your company has been essential due to the hiring of your services.

Likewise, you or your represented entity will be responsible for the data owned by your employees and provided by you or your represented entity to ARIZA to be processed in accordance with the terms of this notice.

ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION OF YOUR PERSONAL DATA (ARCO) AND REVOCATION OF CONSENT.

You have the right to:

  • Access your personal data that we possess and details of their processing.
  • Rectify them if they are inaccurate or incomplete.
  • Request the cancellation of them when you consider that they are not necessary for any of the purposes stated in this privacy notice, are being used for non-consented purposes, or the contractual or service relationship has ended.
  • Oppose the processing of them for specific purposes.

TRANSFER OF YOUR PERSONAL DATA.

We inform you that your personal data may be processed directly or indirectly by ARIZA, by delivering or allowing it to collect your data and/or if you subscribe on your own behalf or on behalf of a legal entity or another individual the contracts, agreements, or documents that formalize a legal relationship with ARIZA, you consent to their processing and transfer both within and outside the country and understand that they may be processed by subsidiaries, affiliates, related entities, authorized distributors, business partners, and/or third-party service providers with whom you have a legal relationship, and by individuals other than this company, as well as, where appropriate, competent authorities. Except in cases provided for in articles 10 and 37 of the FLPPD, for which the consent of the data owner is not required, if you do not express your opposition to the processing and/or transfer of your data, it will be understood that you have given your consent for it.

The data collected for the purposes indicated in this notice may be sent to servers, entities, and/or related third parties outside the National Territory, always ensuring confidentiality and proper treatment with complete security and in accordance with the law.

ARIZA, to fulfill the necessary purposes described above or others legally required or by competent authorities, will transfer the necessary personal data to its affiliated and subsidiary companies.

LIMITATION OF THE USE OR DISCLOSURE OF YOUR PERSONAL DATA.

The confidentiality of the data is guaranteed, and they are protected by administrative, technical, and physical security measures to prevent their damage, loss, alteration, destruction, use, access, or undue disclosure. Only authorized persons will have access to your personal data.

PROCEDURE AND MEANS BY WHICH ARIZA COMMUNICATES THE TERMS OF THIS PRIVACY NOTICE AND WILL COMMUNICATE POSSIBLE CHANGES TO IT.

  • Your request must contain: Name, address, and means to receive communications, identification or document accrediting the legal representative's personality, a clear and precise explanation of the personal data to which you require access, rectification, cancellation, opposition, or revocation.
  • The deadlines to address your request are: Once your request is submitted, we have a maximum period of 20 business days to respond, and 15 business days to make effective the exercise of the right you request, if applicable. Deadlines may be extended by an equal period when there are justifying circumstances. Article 32 FLPPD.
